Not already claiming

We ensure that the consumer has not already instructed someone to deal with their Housing Disrepair Claim for them.

Mould

We check to ensure that any cases we present do not have mould as their only source of complaint.

Council/Housing Association tenants only

We ensure that we only canvass for Council/Housing Association tenants only. We do not target private landlords for Housing Disrepair cases.

Tenancy

We check that the tenant has occupied the property for at least 6 months.

Landlord had been notified

We check that the landlord has been notified at least with a minimum of 3 months’ notice of disrepair.

Defects must be ongoing - Landlord has failed to repair

We check that the landlord has not fixed all the disrepair at the point of claim.

Rent Arrears

We check the consumers rent arrears. We process only those cases where the arrears does not exceed £1,000 Rent Arrears unless the case is extremely strong.

Repair Value

We take a reasonable estimation that the repair value exceeds £1,000.

Images

We check that images are available or possible to demonstrate the disrepair.

Damaged Belongings

Any damage to belongings requires the consumer to produce copies of purchase receipts.

Tenant to provide evidence/record of reporting

We establish with the potential claimant that they have a log of when they informed the landlord and that they have images of the disrepair.

Personal Criteria

Personal Injury to be evidenced by obtaining medical records

If the consumer wishes to claim for Personal Injury as well as Housing Disrepair, then we check they have the injury on record at their doctors and confirm that the injury is related to the Housing Disrepair e.g. breathing issues as a result of damp/mould or a mental health issue affected by the disrepair.
